If he was involved in the fraud, yes. If he wasn't, the club may well revert to him. If Whyte and Green are both committed of fraud, who then owns the club? If Whyte and Green and the non-minted Mint are all committed of fraud, who then owns the club? I realise that there is the oldco newco company confusion to take into account.... What work was being done to "tidy up" whyte's history prior to his unveiling to the masses? Did all the Directors of Rangers Oldco. follow their fiduciary duty to the company they were Directors of? Lots and lots of questions - hopefully soon to be answered in the Court. And,of course, was SDM forced to sell to Whyte ? No work was done to 'tidy up' Whyte's business history.
