SPFL Season declaration challenged legally (ongoing discussion)

Just seen a document on Twitter (don't know how to link / copy to here) stating that if you didn't agree with the proposal you did not need to submit your vote. Hence abstain = No. So even if Dundees vote was not received or placed then it's automatically a no. 

 

Document also states once you've voted for the proposal you can not change your mind - your locked in. However, if you vote No then you had 28 days to change your mind (or may be have it changed for you??) !!!!!!

If we had a decent journalist out there ... as well as CEOs of all clubs concerned, you would demand answers to important yet utterly simple questions:

 

- Who came up with the first SPFL proposal?

 

- Who decided that Friday 17 o'clock was the deadline?

 

- Who spilled the voting numbers before all votes were in?

 

- Who decided that any "non-voters" actually get 28 days?

 

- Who decided that non-voters get time, but  Yes- or No-voters not?

 

And not some assumptions or conjecture, but the people behind those plans and "rulings". Simple question very much in the interest of any club concerned.

 

As well as a rule by rule explanation why the above could be and had to be done as it was.

ND emailed back to say that before the resolution could be circulated by the Board there needed to be a requisition by at least 3 clubs

James Blair spoke to Rod McKenzie regarding the resolution. There was no suggestion of any issues with the text

RFC emailed the resolution to the SPFL
SPFL acknowledged receipt shortly thereafter. No issues were raised with the text then or at any other time until we contacted them further.
James Blair was advised by Stewart Robertson late Thursday evening that the SPFL had suggested to Championship clubs that the resolution was not competent
and wouldn’t be sent to members. They were being told this before the SPFL had communicated with us on the resolution.

James Blair emailed Rod McKenzie asking if he could advise how the resolution might be amended to overcome any concerns the SPFL might have.

Rod McKenzie replied saying he had forwarded to Neil and Iain Blair. He did not otherwise respond

JB emailed back saying it would be helpful to hear from him in advance of the board meeting scheduled for this morning. That didn’t occur.

Friday

Rangers release statement- “Over the last 36 hours, we have received numerous reports from fellow Scottish clubs relating to attempts to coerce and bully them into voting for the SPFL’s own resolution. We are proud that many fellow clubs will stand strong and not be swayed.”

James Blair emailed this morning and then spoke to Rod McKenzie.

“We have seen a statement from Rangers that they “sought comment from the SPFL Executive on several occasions yesterday, to ensure [their] resolution was deemed competent”. For the avoidance of doubt, only at 10.18pm yesterday did the SPFL’s lawyer receive an email from Rangers seeking advice on the content of their resolution, which was put before the SPFL Board first thing this morning.“

“WE have been presented with evidence via a whistleblower that raises serious concerns surrounding the SPFL’s processes relating to its stewardship of the voting on the resolution presented to member Clubs.

Rangers’ Interim Chairman, Douglas Park, attempted to discuss this evidence with SPFL chief executive, Neil Doncaster, who initially refused to do so. The SPFL followed up that call with an e-mail, which we believe was a thinly disguised attempt to silence legitimate concerns”

Rangers have received many media enquiries regarding how our own resolution is progressing.

A spokesman for Rangers advised that Rangers Company secretary, James Blair, has had several email exchanges with the SPFL legal adviser, Rod McKenzie.
Remarkably, we have learned from an email received from Mr McKenzie that our proposed resolution is deemed unnecessary because the SPFL board already has the authority to provide loans to member clubs which can be exercised by the SPFL at any time.
The Inverness CEO, Scot Gardiner, confirmed on national radio yesterday that SPFL representatives made it clear on several conference calls that it was necessary to approve the SPFL resolution in order to release funds which would relieve the financial hardship being experienced by many clubs.
Member clubs will be shocked to learn this is not the case and any club facing short term financial difficulties should request a loan from the SPFL immediately.
Our resolution was never intended to release end of season fee payments but instead to provide loans as an advance on such payments. It is now apparent that this is already within the power of the SPFL.
This provides further evidence that an independent investigation is urgently required.
