The big players (Murray, Lloyds/HBOS) save Ticketus would probably have known of Whyte's directorship ban and since his ban was up it isn't really a factor, he was smart enough not to fill in the declaration on the Ticketus paperwork and in any case they broke their own rules dealing with him. The important part of the case is whether the money paid to the bank was a result of unlawful financial assistance (illegally using the company's own money to fund the takeover).
  2. MIH are irrelevant to Oldco which was probably for all intents and purposes the reasoning behind the deal.
  3. Did Whyte not transfer the shares to Green hence the Sevco 5088, Sevco Scotland debacle. The status of Sevco 5088 is "active" and despite being given a Directorship ban Aidan Earley in an extremely rare move was given permission to remain as a Director of Sevco 5088.
  4. I doubt the manager or prospective DoF are coming without a firm commitment of adequate funding or else we could have saved all the hassle and appointed McLeish or Davies .

How can you claim to support the board, state they're doing their best then hope they can find investment when you renege on a promise to support the resolution that would have paved the way for that investment. He's taking us for idiots and not for the first time either. He's far from stupid he's not broken his silence for no reason, that's him and Walter singing from the same hymn sheet but for whose benefit.
  6. It's nothing to do with blame, the MD stated quite clearly we were going down the DoF route he didn't state we were appointing Ross Wilson. If we don't appoint a DoF then he looks foolish for stating we were going down that route. What any potential DoF gets elsewhere is irrelevant to us.

  15. From my view in the WE I have to agree, if that's the standard for a red we should be seeing a lot more of them in Scottish football. You know as soon as Clancy is confirmed as match ref he's going to screw us over.

  17. They assumed the risk themselves didn't they? Ostensibly to avoid the farcical situation of suing Charles Green in Civil Court whilst simultaneously paying his legal fees and to avoid paying his legal fees in any criminal case he faces That's a black hole as sadly we're not privy till things like a shareholder attempting to jail the Chairman, writs being served on Directors etc become public. I imagine that would be perfectly possible but don't know if it's feasible (though I lean towards it being so).
  18. Pardew is such an uninspiring option even without his ties to Ashley and Llambias. If he is anywhere near the top of the list then it's clear the fans ambitions are higher than the Boards. I'd like to think the Board are more progressive than that.
  19. I'd prefer to see truly independent non-executives on all the boards including the subsidiary companies but concede that is extremely unlikely to happen.

Undoubtedly they should be remunerated at the commensurate rate for the job and their experience but asking them to do so without liability insurance in the current climate is a hell of an ask and would severely curtail the pool of potential candidates. I don't think anyone would have a problem with truly independent directors being remunerated. I'd also prefer them to come from a business background rather than an accountancy background as there's plenty of them there already.
