Are you now complaining that the sanctions weren't as harsh as they should have been? :D

 

If they had relegated us down a division and kicked us out the cup so be it, that punishment is on the books. But instead they choose to come up with an embargo out of nowhere and keep us in the league out their own self interest.

 

That was the point I was making.

As has been said, if we have done something wrong there should be punishment. Not least for the responsible people. But this punishment should be transparent and in the rules. What stops another SFA congregation to whip up a far weaker penalty for a similar offence to ours, or one far more grievious?

The member clubs voting against the JP having unlimited powers.

Is that a statement about facts already known, or you telling us that we should accept that?

 

That's a statement explaining what would need to be done to stop the JP from deciding what sanctions to award to teams.

I think this is a quick action to get judicial opinion on whether the club have a case - possibly to indicate if a trip to the CAS is worth it.

 

For that reason I doubt there would be any UEFA/FIFA censure as it stands.

 

According to Gregory Ioannidis (the sports lawyer guy) the SFAs' Articles don't permit an appeal to CAS because they claim the findings of the Appellate Tribunal are final and binding.

 

It appears once more we find ourselves in uncharted waters.

You couldn't make this up , UEFA under their new financial fair play rules , on advice from legal representation , have dropped the very same sanction ( transfer embargo,s ) from their list of punishments as they are illegal and against EU law on trade .

 

The Telegraph had an article last week on this .

Maybe we've got a slim chance of getting somewhere if our lawyer uses that argument as part of our case?
