just read on the teletext that mr green has stated that the players will transfer to the new company as they are under contract well i would think that once the present company ceases to exist they can walk away as they will then be under contract to no one .

 

the same line of thought goes to the spl and the sfa they cant give the new club any kind of sentance or the old one a sthe old one will also not exist .

As with most issues at the moment there seems to be uncertainty.

 

In any case, it's unlikely we'll be able to afford the existing contracts so it's probably inevitable most, if not all, key players leave while others may have to (or will want under TUPE) renegotiate there's.

I wouldn't be in the slightest surprised if Greens' reasoning is flawed.

 

I would be, it seems straight forward enough.

 

I would think that once the present company ceases to exist they can walk away as they will then be under contract to no one .

 

Would the players contracts not be transfered to the newco as part of the clubs assets, meaning they are contracted to the newco before the oldco is liquidated ?

 

If they refuse to go newco they would then like Green said be in breach of contract .

I would imagine Greens main concern would be in regards to receiving a fee for them.

employment law is clear you can't make an employee change companies.

 

the argument that players are assets not employees is interesting.

 

What about when an existing company is bought over like the bank of Scotland and becomes Lloyds Bank of Scotland, does that mean that the staff where in essence unemployed until they were offered their old job again ?
