Exactly, and the situation now appears to be a lot more immediate than it was back then.

 

The situation would have been a lot more immediate back then if Whyte had actually been paying the PAYE & NI bills.

Interesting pattern emerging with Ahmad and the timing of his legal pursuits too....

 

- Laxey & Easdale credit/loan 'facilities' announced and within days Ahmad is in Court looking for half a million quid.

 

- 'Open Offer' of shares announced and within days Ahmad is in Court looking for half a million quid + £120k legal expenses.

You would expect the court will wait with any decision till after the share issue, as it is by no means certain that there won't be any cash available. Likewise, the company he is chasing with his claims still owns various assets that are there "for the taking" should he get his wish.

 

As Zappa said, it is quite strange that this stuff always comes up close to these critical decisions. Ahmad will obviously claim that he doesn't want to harm the club, but is only looking after his "investment".

The Court will not wait for a share issue - that share issue may not even take place if there isn't enough of a subscription. The Courts don't wait until it is convenient for one of the parties to have their case heard.
