So HMRC could claim despite the fact that the tax laws in place at the time of EBT's may have been adhered to???

 

The question originally posed was whether HMRC could claim interest and penalties for what is, in essence, a retrospective change in the legislation. The answer is that yes they can, even though it seems completely counter-intuitive to me.

 

The rest of your posts subsequent to this one are irrelevant to the actual question asked, you are looking again at whether or not the tax legislation was adhered to - which is a different question entirely.

As a wee extra to this thread Green has lost his case re us paying his legal costs.DK has said he will now pursue him for recovery of the coasts that have been incurred.

Another good victory against the mob.
