I may be trying to be too smart-alecky here - but I read that as 'Dear Mr Daly, here's where you were way wrong. A wee apology will do, failing that we will see you in court.'

It's like an offer to meet, maybe not halfway, but 70-30.

One thing the emails do prove (the first one from Whyte to Grier) is that Bill Millers "incubator" scenario was not thought up by Miller at all but by Whyte (point 3 in the first email), so either Whyte or Duff & Phelps pushed the notion to Miller/Club9.

Bill Miller could easily have decided that himself. It is the most obvious option after a CVA.

Shows nothing other than Whyte being over optimistic about administration, which I remember anyway. He said he wanted to exit admin by March payday.

From day one Duff & Phelps were on about non-liquidation liquidation (which is what exactly point 3 in Whytes' email to Grier is) ergo they were talking about that scenario pre administration, it's pretty clear it emanated from this side of the Atlantic, Bill Miller did not bring to the table as it was already there.

Agreed. No doubt Miller had some business advisors on this side of the pond to keep him appriased of his options, but the fact he was attracted to the deal in the first place, and that this was his preferred option, suggests that it was put to him by someone. Answer's on the back of a stamp as to who...
