I fear many of you are missing the point of the legal challenge (funded by the RFFF*) it has been raised against the restriction of trade - viz-a-viz transfer embargo and its repercussions to the trading business.

 

* Which a fighting fund is for we would think.

Maybe we've got a slim chance of getting somewhere if our lawyer uses that argument as part of our case?

 

Zappa , UEFA and FIFA have both publically came out and stated they would not be getting involved in this because they not only know the SFA are wrong but have privately informed them that the punishment that has been handed down is unenforceable , ( UEFA have informed them )

I thought we were challenging on the grounds that the SPA acted ultra vires in imposing the registration ban.

The word used was prejudice and my understanding is that in this instance it is claimed to refer to restrictions on the ability of the business (Rangers Plc) to carry out trading in a fair and equitable manner in relation to its competitors.

 

The challenge is a not of a sporting context and maybe thats why Fifa appear to be keeping well away from it.

uefa can't enforce this type of ban but the sfa can. that's what uefa have said before. all uefa could do was ban them from Europe which would cause problems with restrictions of trade.

 

restrictions of trade whether in a home associatiion or in europe is a restriction of trade , borders or associations do not come into it .

yes but a registration embargo is different to a European playing embargo.

 

there could be some mileage in this restriction of trade route but its by no means certain a.d we would need a player prepared to sign for us then take it to court.

 

the club can't do that we aren't being stoped from playing.
