  1. That's a bit closer to the truth of the matter. Impossible to see how Mr Kinloch can win this case. He must have deep pockets to pay the lawyers for 5 years plus the court case.
  2. Well that would be wrong as well, wouldn't it? Strictly speaking "relegation" is To assign to an obscure place, position, or condition." which is certainly what happened to us. In football terms, of course, promotion and relegation ordinarily mean going up or down one division at a time on merit but that is not always the case. Consider the strange case of Fiorentina who went into judicially-controlled administration in June 2002: The club was promptly re-established in August 2002 as Associazione Calcio Fiorentina e Florentia Viola with shoe and leather entrepreneur Diego Della Valle as new owner and the club was admitted into Serie C2, the fourth tier of Italian football. The only player to remain at the club in its new incarnation was Angelo Di Livio, whose commitment to the club's cause further endeared him to the fans. Helped by Di Livio and 30-goal striker Christian Riganò, the club won its Serie C2 group with considerable ease, which would normally have led to a promotion to Serie C1. Due to the bizarre Caso Catania (Catania Case), however, the club skipped Serie C1 and was admitted into Serie B, something that was only made possible by the Italian Football Federation (FIGC)'s decision to resolve the Catania situation by increasing the number of teams in Serie B from 20 to 24 and promoting Fiorentina for "sports merits." In the 2003 off-season, the club also bought back the right to use the Fiorentina name and the famous shirt design, and re-incorporated itself as ACF Fiorentina. Still if that is the defence rather than the newco/oldco argument, Coral need new lawyers.
  3. We all know that this is not correct and it seems an odd defence when the truth is a complete answer to the false claim. Is it possible that Coral's lawyers simply don't understand what happened? It's hard to believe that if they know the facts that is their entire defence. I said earlier that "I can't see how the bet was void, since it is provable through FIFA, UEFA and even the SFA and the SPFL that Rangers are the same Club. So the defence that the Club ceased to exist ergo they weren't relegated is false." But if Coral truly believe that to be true, I can see that that would void the bet in their eyes and thereby the punter should get his stake returned; perhaps that's what they have done? They should just have called Doncaster as a witness, he confirms Rangers were not relegated, bet lost, end of story.

I think it's fairly obvious both will be "involved" at some stage but can someone please explain to me the logic behind: “Jon and Emerson are two very talented players and they will put pressure on the other players and I know they will respond accordingly." Both midfielders come to the club able to play in an area of the team that Warburton identified as needing bolstered due to injuries and other circumstances, with Matt Crooks the latest to become unavailable for selection due to his loan at Scunthorpe Warburton explained the reasoning behind the move for Crooks: “We lost a lot of players there (midfield), with Jordan Rossiter about to come back, with Niko Kranjcar picking up his injury and Joey Barton etc." If we have lost a lot of players in midfield i.e. Kranjcar, Barton and Rossiter; surely that would be an ideal opportunity for Crooks to play if he was good enough, rather than making him unavailable through a loan to Scunthorpe? It seems to me that bringing in Jon Toral and Emerson Hyndman to "put pressure on the other players" is a clear indication that the manager knows that Halliday, Windass and Holt, never mind Crooks, simply aren't good enough or at least not good enough on a consistent basis and contrary to what else he says "No one is ever guaranteed a shirt"; that has been precisely the situation with Halliday and Holt at least (who have both started every game since Celtic away) and it's arguable Windass as well who has started 7 out of the last 9 games when he was fit. It was difficult to assess Toral who was played out of position in Leipzig (nothing new there) but should be the ideal temporary replacement for Kranjcar in CMF; but Hyndman had an excellent second half in a team that was toiling to compete with the fast flowing play of the Germans and certainly looked capable of challenging either Holt or Halliday for a starting berth.
  5. I'm not sure how we can "release" players mid season unless their contracts end on say 31 January, which seems unlikely. So either these players have teams to go to who will match or near match their wages, or we have paid them off. It seems Aird at least has gone to Falkirk, it's not clear if Walsh is staying at St Mirren but Wikipedia has him as a free agent https://en.wikipedia.org/wiki/Tom_Walsh_(footballer) Both looked to have great potential but failed to progress; something wrong somewhere. Tom Walsh in particular has been with the Club for 10 years but only played 10 games.
  6. I don't think that's the suggestion here. The judge said "both defenders (the footballers) took advantage of the pursuer" I think that implies that they were compos mentis and she was not, at least in the judges opinion.
  7. I think the judge's point is that she was so drunk as to have sex forced upon her rather than being able to give consent to "have sex" i.e. consensual sex.

Clearly he was assuming we would be docked 30 points or so (don't remember the formula or the numbers quoted at the time) but that didn't happen. So his claim is completely spurious and he is bound to lose. If he has any money Coral would probably claim and be awarded costs but it is a complete waste of the Court's time and he should pay for that as well.
  11. He's certainly wrong about one thing; the legislation does not mention "sectarianism" because the Government could not define it. However, there is no chance whatsoever that the SG will scrap this legislation voluntarily.
  12. We were discussing this post match. Mackay is the only player we have right now that MIGHT get a game for Celtic. I think he'd struggle against strong players in the EPL but in Germany or other European Leagues he might find his skill harnessed to the team tactics. He showed Leipzig that he could beat their players with ease; they and others like them have the quality to take advantage of his play, sadly we don't. It would not surprise me in the least if RBL made a bid for him.
  13. I don't think your information about the coefficients is quite correct. This season's Access List is based on the 2015 Country Rankings in which we were 23rd. On that basis the CW went into ELQ2 and the 2nd and 3rd in the League went into Q1. Scotland were indeed 25th in 2015/16 which is the base for next season's Access List but the same Access arrangements apply. Below 25th, you are correct that CW, N2 & N3 go into the ELQ1 but oftentimes, in fact usually, something happens higher up to give lower teams a boost. This season for example: The Champions League title holder spot is not used since Real Madrid already qualified for the group stage by the domestic league. This implies that the Europa League title holder Sevilla gains access to the Champions League group stage, leaving an empty spot in EL-Q3. In order to fill the gap the cup winner of the 18th country on the ranking list (Cyprus) has direct access to the 3rd qualifying round, and the cup winners of the 26th and 27th countries on the ranking list (Norway and Serbia) have direct access to the 2nd qualifying round of the Europa League. On May 18 the UEFA Executive Committee decided that the domestic champion and the domestic cup winner of Kosovo will be admitted to the first qualifying round of the UEFA Champions League and UEFA Europa League. For this season the clubs of Kosovo will have to meet the special permission licensing criteria under article 15 of the UEFA Club Licensing and Financial Fair Play regulations. However, the Kosovar clubs did not get a license. This implies that the champion of the 46th country on the ranking list (Latvia) has direct access to the 2nd qualifying round of the Champions League, and the cup winner of the 28th country on the ranking list (Slovenia) has direct access to the 2nd qualifying round of the Europa League. I stand to be corrected on the above in the light of the new arrangements for the CL announced by UEFA. I totally agree with your second point, which means that in effect the best bet for any of our players wanting a holiday is if we don't get to the Cup Final so the last game would be on 21/22 May; but even then it won't be more than a week or two at most. I don't believe that the current team are good enough to survive two EL qualifying rounds never mind Q3 and Q4, so if we don't add more quality to the squad now, we won't have any additions before we start back in earnest in Europe this June.
  14. The train times aren't available for that weekend yet but looking at the previous weekend then the answer is, YES, leaving at 07:48 arriving 11:47. However, I have always gone up to Aberdeen the night before, sadly it's been 5 years as I said I didn't get one for the first game this season. So that makes two reasons for not going this April; one being no ticket the other being Sat the 15th is my birthday. I only got two, Celtic and Killie, like you. I am not sure if I'll be here for the Killie game but if I am I'll take you down.

If the defenders were sufficiently aware to give evidence that Denise wasn’t “particularly affected by alcohol”; I would think the suggestion was that they weren't particularly impaired; otherwise how would they know. Also if they "took advantage of the pursuer when she was vulnerable through an excessive intake of alcohol and, because her cognitive functioning and decision making processes were so impaired, was incapable of giving meaningful consent"; I would take the implication that they were fit enough to rape her and she was incapable of saying no. If both parties were equally drunk and incapable then it seems unlikely that sex would have taken place at all.
  16. According to email received this morning I don't have a ticket for either game but would drive up to Dundee if I get one. I would train to Aberdeen, if a ticket came up but my sources in Aberdeen couldn't help last time due to reduced allocation.
  17. And yet MW starts AH and JH every game and most often they don't get subbed either. It will be interesting to see if either of the new lads can force them out of the team; I have my doubts as they seem firmly entrenched in MW's mind.

  19. You may or may not be aware that both David Martin and Robin Howe were at the match, they were to be found together at the top of the first flight of stairs. As I've posted earlier in the thread, the Police operation was outstanding both to and from the ground, to the extent of anticipating that some fans would want to walk back to town and they even had a van posted in the park to light the way for us with headlights. So it's sad to hear of your bad experience; but as you know from past trips, the locals do not always follow what is agreed in advance (assuming that something was actually agreed). It does sound, however, as if you had the better of us able bodied chaps in terms of the toilet facilities, which were tight and very crowded to say the least.
  20. He was completely out his depth (as were Halliday and Holt) against Leipzig. There was one crazy spell in the first half where he twice passed the ball straight to RBL players and then the next time he had it one ran up and easily took it off him. I just think that a lot of these guys especially Tavs and Holt looked great against very mediocre opposition but simply aren't good enough to step up to SPFL level never mind a top class German team like RBL.
  21. We probably haven't paid more than half the money; they might be prepared to give up whatever's owed to get him back. He's had plenty of opportunities and proven he's no use to us.

So it would seem but my point is that however far over the line he went it is clear that it was not far enough to warrant a charge of gross misconduct leading to instant dismissal or even dismissal after a hearing. The reasons I say it was rank bad management are that the initial suspension (presumably on full pay) was extended (for no obvious reason), which is very unusual if not unique in my experience; Barton clearly outplayed Rangers management strategy with his sick note; and therefore eventually we had to pay him off. I have a bad feeling that the senior players simply told MW that they weren't prepared to play in the same team or perhaps have him in the same dressing room and that forced Rangers hand. I would stress that this is just my theory, I don't have any evidence to back it up.
  23. I'll accept the compliment on behalf of all those who travelled, Bearman. That said, I think there must have been fair few who didn't make it out of Berlin, as it didn't look to me that we had the much talked about 8,000 in the stadium out of the 18,000+ crowd. I know that a lot had bus arrangements but I don't think there were more than a couple of thousand on the march from the square to the stadium. It wasn't an easy trip for those (me included) who left it too late to get cheap flights with one stop to Leipzig; and on the back I heard that some of the troops were stranded, in or en route from Dusseldorf I think, as their first flight was delayed and they missed their short connection. I think the Leipzig breweries will have to work overtime to replenish their stocks
  24. I hope you got in OK. I met a guy who is perhaps semi-disabled (if that's not a contradiction in terms) following a hip operation and he said the stewards were anything but helpful. I trust there was a way for you to avoid all those steps and that your chair did not take off on the ice rink outside.
  25. Failing to resolve the Barton situation was rank bad management and the aftermath made us look extremely foolish. No argument he was his own worst enemy but it seems he said some things that needed to be said. We could certainly do with him now.
