Ashley In SFA Court Battle

Recommended Posts

I just love how the Daily Record can use, " "The Scottish FA can confirm we have received a petition for judicial review and will be defending it. We will make no further comment at this stage." as a basis to lead with the headline, " The SFA fire back at Mike Ashley over Rangers ruling: We'll fight you every step of the way ."

Probably non-attributable comment from DB.

"Thoughts of many others?" Suspect that there might be many others like me, who can't figure out your reasoning. Please share it.

It's well known hereabouts that I agree with those who take the view that Mr King is not "fit and proper" in terms of the SFA guidelines and I was astonished with the SFA decision but I also agree with the comment that this seems a pointless exercise at this stage. I don't know the legal technicalities but tend to agree that if the SFA followed proper procedures I doubt the Court would or could set aside their decision.

That said I follow the Rangers whoever sits in the boardroom as I have done through these past four traumatic years.

Newcastle United owner Mike Ashley wants the fine thrown out by the court.

BILLIONAIRE Mike Ashley has launched a second big money legal case on the governing body of Scottish football – because he’s refusing to pay a paltry £1000 fine.

Eight months ago the SFA hit the Newcastle owner with a £7500 fine for breaching their rules on dual control because of his influence over the previous Rangers regime which was led by his right-hand men, Derek Llambias and Barry Leach.

In June that sum was reduced to just £1000 after Ashley’s lawyers appeared in front of an appeal tribunal at Hampden .

But Record Sport can now reveal that the bill remains unpaid and that Ashley is now paying through the nose to have it booted out at the Court of Session in Edinburgh.

The Sports Direct magnate has demanded a judicial review of the penalty and the case is set to be heard on February 4.

It’s believed the final legal bill for dragging the SFA back into the dock could top £100,000.

A victory for Ashley’s highly-paid team of QCs would leave the SFA having to pick up that entire tab.

It’s the latest in a string of overtly aggressive moves from Ashley as part of his ongoing feud with new Rangers chairman Dave King , the man who toppled the previous Rangers board.

The Record has already revealed that King could face Christmas in jail if Ashley’s lawyers win a contempt of court charge at the High Court in London on December 9.

They have demanded that King is banged up for breaking a gagging order which Ashley took out to block him from disclosing details of the club’s onerous commercial tie-ins with Sports Direct.

Two days later, on December 11, Ashley will have the SFA up at the Court of Session in Edinburgh for a judicial review of their decision to clear King as ‘fit and proper’ ahead of his appointment to the head of the Rangers board.

Furious Hampden bosses fear that case alone could cost the Scottish game a small fortune, even though they remain confident of winning given the weight of legal advice behind their decision to give King the all clear despite his tax convictions in South Africa and his previous role as a director on Craig Whyte’s Rangers board.

But now they are livid at the thought of being forced into a second courtroom trial all because Ashley has refused to accept their £1000 dual-control sanction.

It’s estimated a loss for the SFA could cost the game around £100,000 – a sum which could buy half of a new 4th generation artificial pitch, or keep four community coaches employed for a year.

A source said: “Ashley’s aggressive behaviour towards Scottish football is getting completely out of hand. His personal vendetta against Dave King and Rangers was one thing but it’s now spilling over into other areas which could effect (sic)the whole of the game in this country.

“As if Scottish football doesn't have enough problems of its own already now it has Ashley running around like a bull in a china shop.”

So, the SFA don't care if one of its clubs is under attack as long as:

A) it is Rangers

B) they are not involved.

Charmless admission of what we are up against in Scotland

" Ashley’s aggressive behaviour towards Scottish football is getting completely out of hand. His personal vendetta against Dave King and Rangers was one thing and is perfectly acceptable to us. In fact, more power to his elbow with that one. But it’s now spilling over into other areas which could end up costing somebody else outside Rangers money. And we can't have that. "

Ashley is starting to be reminiscent of a fat Montgomery Burns, complete with his posse highly aggressive lawyers. He's incredibly rich, powerful, evil and takes everything personally.

It's a horrible combination that can lean me towards a more socialist point of view (from around the centre). People just shouldn't be allowed to become that rich, it's just obscene and highly dangerous.

The thing is what laws will it be under as we in Scotland have our own laws.As it is cross border confrontation will Ashley demand it be held in E*****d if he loses in Edinburgh?.

I would think that the SFA Articles state any disputes are heard under Scots law
