Ex players seeking holiday pay

Recommended Posts

Could they be contractors?... in which case you don't get holiday pay or pension or any of the normal add ons. Would also fit with the fixed duration of a footballers contract.

No as they can't send someone else along to play when they are injured. They are employees.

Surely if the club are refusing to pay the 'HP' then they must have in their legal opinion, grounds to do so.

Football is a profession where in the main games seem to dictate when a player will be 'busy' and there is little scope for an individual to seek 'time-off' outwith what would be downtime for the squad as a whole.

If within International breaks during the season the footballers are given say 5 days off, would that count as 'holiday' ?

I suppose it depends on how the contract is worded. I can't see how football contracts are anything close to your average ones, but anywhere I've worked, if you have accrued holidays you haven't taken by the time you leave, then you are paid for them in your final salary. Of course, if you've taken more than you've accrued that is also removed from your salary.

Not only that but as the club would be their sole "customer" this also lends itself to being subject to Schedule E tax.... Which is tax as an employee
