If Whyte was found guilty it would have taken away that court case - with him being found innocent he can push forward. It seems to me, naively, possibly, that the content is actionable, if untrue. Perhaps, however, any litigation would place dark matters in the spotlight, and therefore would be unlikely to be pursued . Make your own mind up.
