So just to get this straight: this is not about whether SD would be willing or able to match or top our deal with Elite (or whomever) but simply that we informed them not according to every minute detail in our previous contract with SD?

 

Questions:

Did SD get access to the new deal by now?

 

In case they have, are they willing to match our current deal?*

 

If not, the new deal with Elite (et al) would simply continue as it is?

 

If yes, we are probably bound to strike that deal with SD (under the same terms as the new deal?) and wouldn't loose out ... but may have problems with the company we struck the new deal with?

 

 

* I take it that they will take the longest timescale available before handing us an answer ... unless we already have one.

Not knowing the legal ins & outs....I would assume that we may be made to stump up some kind of compensation to SD & the deal is effectively declared null & void as a result.  Everyone moves forward.

 

If that is the case, could it have been a "calculated risk" from RFC???  in that the compensation may prove to be less that lost revenue as a result of a SD deal.

Sounds to me like King is just being obstructive and playing Ashley at his own game by dragging SDI through the courts in the hope that he gets fed up and relents. 

 

Hope it works.

 

Will be interesting to see if the verification of SDI's legal fees are indeed found to be too high.

That would be an expensive waste of time.

 

It looks more like it's SDI that we can't manage to shake.
