Rangers statement on the stripping of titles

I read this on FF yesterday, and thought it cut to the heart of the matter. I hope the poster Disco Dee Jay doesn't mind.

 

 

''As long as an organisations rules are strictly followed and in themselves are not unlawful, the Courts do not have the power to overturn them.

 

The judge in the SFA Transfer Embargo punishment, did not have the power to overrule the guilty decision, only the punishment, as it was not an option available to the tribunal.

 

He confirmed this in his explanation as to his final decision, when he told the SFA to reconsider the punishment.

 

He also stated that he had no power over whether the next punishment should be more or less severe than the original punishment, purely that it should come from the list of options available and not be one that they made up on a whim.

 

However, withholding or withdrawing titles is an option available to the SPL, as is an unlimited fine and unlimited compensation to other clubs and they have no doubt learned from the SFA's errors, so won't make the same mistake of using a punishment not available to them.

 

Unless they feck it up, our only line of appeal will be, in the 1st instance, to the SFA (no laughing please) and then the Court of Arbitration for Sport''

This may have been covere but surely once we return to the SPL a condition will be we give up the titles. A fact(?) people may well be missing

 

 

Looks like we may be outside the SPL for quite a whie then.

 

They may have blackmailed us into giving up our TV rights this season but try it again in a couple of years time and see where that gets them. What will the financial fall-out be if we don't return?

 

The SPL have more to lose than us.

No, it annoys me how gullible and ignorant a lot of bears are. Club almost destroyed by two evil nut jobs and already lapping up the involvement of another 1. This one should be easy because unlike Murray and Whyte he actually has previous for ruining a football club.

 

Dodgy shyster crooks like GDS should be told to not go within a million miles of our club. If we get caught out three times then we have little left to argue about.

You wonder though why no-one else of our thousands of shareholders and club representatives do not make a case of this like him, or at least ask the releveant questions. Nigh all of them either keep their mouths shut or ran amok on the various message boards, where their input will yield next to nothing. If people come up denominating hims a *see DA's comment above*, why don't they just follow suit and try to make it better? No disrespect to anyone, but I you wonder about the guts involved ...

What's he done positive so far? Has he achieved anything? Creating trouble and controversy isn't necessarily a good thing.

 

It's not about him being gutsy, he just likes to get involved in crazy situations like this and to cause trouble.

They are denying that the SPL have jurisdiction but if the SPL are forced into court they just have to say that the new company has no claim to those titles as they were awarded to the old company and Rangers have already set out their stall that this is truly the case.

 

This could force the SFA to admit that there is no connection for Rangers now and Rangers then because if the SPL successfully defend the case for stripping on this point it legally proves no continuation and the SFA would have to recognize this.

 

134.2.7 The law governing the arbitration shall be Scots Law.

In the eyes of the governing body...it is the same club - the SFA membership was TRANSFERRED, and not issued new.
