Not really, he chose to take the assets to another company, while merging the companies later if a CVA got accepted for the oldco. As we know he decided he couldn't go through with it.

HMRC said they rejected mainly because they wanted to do a liquidation investigation, so TBK would have needed to offer something very special to make them change their minds on that. TBK are as bad as any fans who won't continue following us if that was the attitude, a CVA was the ideal solution but the club does not die regardless of the company liquidation and the chance was there to agree to purchase the assets if a CVA failed.

It was said from the start it needed to be an unconditional bid.

And that worked against them as well, a newco situation has to be prepared for regardless.
