Like buying a house. In Whyte's case, Ticketus put the money in escrow or a solicitor's cliemt's a/c, allowing Whyte's lawyer to show proof of funds, to be released when/as the deal was signed.

An extraordinary situation. The terms of the contract could not have been enforced by either party? Does this mean that Bain was working without a contract, on a grace and favour basis, and that he was CEO, by habit and repute?
