SPFL - No Further Action Re: EBTs

Recommended Posts

I hope they raise that amount and spend it only to find there is no case to answer for Rangers!

I think everyone who matters has already point blank stated that there is no case to answer. These are compulsive obsessives who will never stop obsessing regardless of reality.

It will continue for them, but not for us. It will however provide us with some ongoing entertainment as they squander more money on these idiotic actions. You'd like to think that the media could be trusted to provide a balanced view, but unfortunately they can't. Arrogant clowns like Tom English are so full of hatred and poison that they are unable to report the facts. Instead he uses words such as 'unlawful' and then foolishly stands by that term because his google search suggests he has used it wisely. We know he uses that word to imply illegal and indeed that is how the Oxford English Dictionary defines it. Both words are synonyms of the other. Had he really thought it was illegal, he would use that term, but he thinks he is being smart and above the law by suggesting it is merely unlawful. Maybe the experts he should consult are his legal experts so that they may better prepare for the inevitable legal challenge to their reporting of these matters.

If however we give him the benefit of the doubt and allow him to claim that unlawful is applicable where an action is just not expressly permitted by law, then I'm quite happy with that. However, I don't see anything in law that expressly permits the use of twitter, or expressly permits the reporting of football related matters, or expressly permits the reading of anything he writes. Does that then mean that his role (paid for by us as 'tax' payers) is unlawful? Does it mean that we are being unlawful in reading his pathetic drivel?

Answers on a postcard. I'd like to know from our legal experts on here. Is this semantics? It might be fun to consider what else is regarded as unlawful.

So, what is Topping meaning here when he says ...

SPFL chairman Ralph Topping urges the SFA to embrace independent review of Rangers crisis

Matthew Lindsay

RALPH Topping, the outgoing SPFL chairman, last night called on the SFA to cooperate fully with an independent review into how Scottish football’s authorities dealt with the Rangers crisis.

The SPFL yesterday announced they had no legal power to punish the Ibrox club further for their use of Employee Benefit Trusts despite the Supreme Court ruling in favour of HMRC in the Big Tax Case earlier this month.

The governing body released a lengthy document outlining the advice they had received from Gerry Moynihan QC and called for a review into how Scottish football handled the issues arising out of the affair.

Topping believes the SFA must follow the SPFL’s lead and embrace a wide-reaching investigation into how they acted and the rules and regulations that are in place.

“If we are going to have a successful review we need our SFA colleagues to aid that process,” he said. “I would be very surprised if there was not a demand for that from the press, public and football clubs.

“If they don’t that’s their decision. I think they would find it hard to have Aunt Harriet approach and sweep it under the carpet or stonewall it. We don’t want Aunt Harriet to have her way.”

Topping added: “Who now sits on the review body? There is a lot of work to be done in that area. We need to work with the SFA on that. That is an absolute imperative.

“There are a lot of good people along at the SFA. There is not one single person in Scottish football who set out to bring about an outcome that suited them.

“We all need to go through that process of scrutiny. I am happy to go through it. The board of the SPFL are happy to go through it. I think everybody in Scottish football should have their opportunity to have their say and the review body report on it.

“I am satisfied that we have gone through the legal process and we have done the responsible thing in terms of getting wiser minds than I’ve got to look at it from a legal perspective. We have taken that advice and we have acted on it.

“People can be critical all they want, but we haven’t set out in anything other than in a sincere fashion to try and do the right thing. If I haven’t or the body hasn’t then it’s a fair criticism.”

Sounds very much that they/he absolutely did not like how the LNS commission dealt with the stuff and probably the result too? And te remark about the press, fans and cllubs is food and drink to the moonhowlers.

All a bit strange this.

The review is to look at how things could have been done differently etc. Although that's already been done and rules changed. As you say dB it's playing to the moon howlers.

Speaking of whom...I hear those evening screams like no other tonight! Must get double glazing.....

The SPFL went through the process of getting away those titles with a fine toothed comb. They found nothing in their rules to do it. Because the SFA took 5 minutes to make a statement they now want the SFA to use the same fine tooth comb to see if they can find a loophole. If you think it is to keep the moon-howlers happy then you are wrong. The process is to remove titles and certain people won't give up until every avenue has been searched.

Keep your money ready. A group is in daily discussions with lawyers mapping out the strategy. Once ready- you will know.

I know it is frustrating when we all want to do something now, but hold your fire. The groundwork must be done for this to succeed. 2/2

Selecting the right group to spearhead a Judicial Review is critical to the chances of success. Lawyers are being consulted. 1/2 "

I hope they put Hoopyghirl in charge of the money collected again.
