Disciplinary Outcomes | Scottish Cup Final

Recommended Posts

There is the fundamental problem both with the SFA and the SPFL that there are people on the boards et al who have direct ties to the clubs, yet who talk and behave as if they were utterly independent and impartial when such decisions have to be made. This is an absolute no-go.

We should perhaps withdraw from the cup. Or indeed from the sfa.

I'm afraid they have got that covered, gs. Penalty for infringement could be up to and including removal of membership.

...

33. Participation in a Cup Tie

33.1 Clubs eligible to compete in the Challenge Cup Competition shall be subject to and

shall comply with both these Articles and the Challenge Cup Competition Rules, as

amended from time to time.

33.2 Failure by any member to comply with Article 33.1 shall be deemed to be an

infringement of these Articles.

33.3 All members eligible to compete in the Challenge Cup Competition, shall so compete

in the Challenge Cup Competition.

33.4 Failure by any member to comply with Article 33.3 shall be deemed to be an

infringement of these Articles.

The charges were set up so as to fail the disciplinary judicial panel's revue, the SFA own lawyers defend Hivs in this, i smell major stitch-up here.

I agree with on the charges and it does feel that Harper & McCleod have a conflict of interest here.

Seems to me that as the SFA do not operate 'strict liability' they were always limited as to what action they could have taken.

PFA Scotland Statement on Scottish Cup Final

Michelle Evans

23rd May 2016

Fraser Wishart, Chief Executive of PFA Scotland, said: “PFA Scotland supports calls for a full and thorough independent and transparent investigation in to the post-match events at the Scottish Cup Final at Hampden on Saturday.

“Safety in the workplace is of paramount importance and it is forgotten that footballers’ workplace is the field of play, where they perform assuming like every worker that the environment is safe. On Saturday this was not the case and it is completely unacceptable that the safety of our members was compromised in the scenes which followed the full time whistle. The wellbeing of our members was endangered and they were left open to threats and intimidation. No-one should have to face these unsavoury conditions in their workplace, be it on the football pitch or an office environment.

“In the lead up to high profile matches such as Saturday’s cup final, players are advised by the authorities with regard to their behaviour on the pitch and the potential consequences in the stands of such behaviour. The players on Saturday behaved impeccably, it was their safety that was threatened and our members were left vulnerable.

“The scenes on the Hampden pitch tarnished what was a wonderful game of football and a historic day for Hibernian Football Club. It is particularly disappointing that both sets of players were denied the opportunity to go to their supporters in the traditional manner; the Hibernian players were denied the opportunity to celebrate a momentous occasion for their club with their supporters whilst the Rangers players were unable to collect their medals and acknowledge their supporters after a long season.

“We commend our members for the restraint shown under severe duress and believe that they are due a full explanation from the authorities as to how and why supporters were able to enter the field of play and threaten their safety.”

Wonder what they think about the outcome?

I don't think Hibs are responsible for the behaviour of their fans. As such I don't think they can be punished. Do we think that The Stone Roses or Calvin Harris should be fined because of the violence that took place at T In The Park this summer? The people responsible for policing T In The Park are the organisers and the police, not the bands performing.

Likewise neither Rangers or Hibs can seriously be held responsible for the behaviour of supporters surely? Short of running onto the park and pushing fans off it the director's of Hibs have no control over what fully grown adults will do in any particular situation. Neither do the Rangers directors, or officials or employees.

This whole thing has been a smokescreen. Those who should be held responsible for what happened are the individuals who took part in invading the park, vandalism and assaults, the SFA as the organisers of the match and the police. Crimes took place, assaults took place. It's the job of the police to firstly prevent this, something they clearly failed at, then secondly to bring the perpetrators to justice. Fining Hibs or Rangers for something neither club has any control over is simply passing the buck. The fact that it was the SFA who were holding this enquiry simply underlines the absurdity of it. Rangers in particlular should be taking legal action against them for failing to provide protection and a safe working environment.

The cries of 'strict liability' are once again buck passing. This simply means the police and the organisers, both who make money from simply doing their jobs at these events, don't want to take responsibility for what happens at them. I think that's absurd.

Rangers supporters are rightly angry that our players were assaulted and some of our fans put in danger. The responsibility for this lies with the SFA and with the police, both of who are looking for someone else to blame. We shouldn't help them do this.
