  2. That's precisely why I underlined "can". He did indeed have that option but then the same time factor would have applied as if he tried to convene his own panel. Basically he had an hour to make a decision. He might have been wiser to try to organise a teleconference OR bat it off on the Appeals Committee as you suggest; but he chose not to. Without doubt he would have been advised by the UEFA Secretariat as to precedents etc; I strongly suspect they would have prepared a paper for him to consider with an outcome already suggested. He would not just have sat in a dark room and meditated for an hour. I am quite sure that some discussions would have taken place, even if ultimately it has been presented as one man's decision. Note that if he had sent it direct to the Appeals Committee there would have been no further appeal available within UEFA (unless they have a procedure for a second Appeal Tribunal to hear the same case, which I doubt) but I haven't checked. So he might have been advised against that route. In any event none of this constitutes grounds for Appeal. Sorry haven't had time to check the Rules they have cited; but you'll know the outcome tomorrow anyway, so not much point in further speculation.
  3. It's clearly an emotive subject for some but I think this is a very important point that should not be overlooked. If just one of the two penalties that Legia missed in the first leg had gone in then the 3-0 award of the second leg would not have seen Legia "ejected" from the competition. They weren't ejected, they lost the tie on the away goals rule after the second leg was declared forfeit in accordance with the rules as is made clear in the Appeal. I would like to have a read up on the rules they quote in the Appeal to see whether or not they might have grounds for overturning the mandatory penalty but I doubt it.

  5. I agree with you on that but it would have been up to the Chair to determine whether or not he felt the need to have colleagues join in the decision making process. I think there would be two issues at least in his mind: The seriousness and implications of the decision, and The degree of difficulty in making the decision Whilst undoubtedly it was a very serious issue, he may have felt that it was clear cut under the rules so no need to involve anyone else. If it had been me, I might have tried to get the draw put back an hour or two so as to at least have a video or teleconference discussion (and we don't know for sure that that is not what happened). As it is he has left himself open to criticism which he could easily have deflected. Sometimes having the authority to act and acting aren't the best bedfellows. (Oh and for the benefit of my good friend Mr Anchorman; this is an area where I do have considerable experience, albeit at a much lower level in football but also in Financial Services Tribunals, so I do feel qualified to give an objective opinion )

Not directly but I think the implication is clear enough: "We understand that acting under the pressure of time and circumstances, the Chairman of the Uefa Control, Ethics and Disciplinary Body literally applied Art. 21.02 of the Uefa Disciplinary Regulations.   7. I suppose they could have postponed the draw but then all the other teams and supporters would be affected. They couldn't do the latter because Celtic were seeded and Legia were not; unless they ruled that it would go on Celtic's seeding, which I guess would have been possible; either way it affected the Bulagarian team Ludgorets and of course Maribor.

The Control, Ethics and Disciplinary Body has jurisdiction to rule on disciplinary issues and all other matters which fall within its jurisdiction pursuant to the UEFA Statutes or regulations adopted by the UEFA Executive Committee. The Control, Ethics and Disciplinary Body shall, as a rule, reach decisions in the presence of all its members, but is entitled to take a decision if at least three of its members are present. The chairman of the Control, Ethics and Disciplinary Body, one of its vice-chairmen or one of its members acting as ad hoc chairman may make a decision as a judge sitting alone if the sanction is limited to a warning, a reprimand, a fine of up to €8,000, a player suspension or a suspension from carrying out a function for up to two matches, as well as in urgent cases.   9. That's fine Mr Anchorman, you obviously were concerned enough about my description to comment negatively on it and take it further. I tried to give you a reasoned reply but have just been met by your customary sarcastic response, so obviously wasting my time. I'll know better in future.

The Chair or Vice Chair has the authority to do that in an emergency, which it certainly was with the draw that morning, they could not have convened a panel quickly enough, unless perhaps by video conference, which may not be allowed in the rules. So nothing really for Legia to go on there I don't think.

There are a number of areas where I do feel qualified to give an objective unbiased opinion, for example where I have met the people concerned or where I can use my refereeing experience, and as you say that's usually obvious. However, I have never met Mr King so all I have to go on are his public pronouncements and so my comments are just my opinions based on my own analysis. If I was writing an article about the pros and cons of his interventions that would be different but all we are doing here is posting opinions on a forum. I think if you if you do some research you will find that I have almost always referred to him as either DK or Mr King. I used King of SA twice recently and it's not exactly offensive now is it; but as I said I'll revert to Mr King (from rather than of) SA as I have no wish to offend your sensibilities on this any more than I do normally.
  13. I said elsewhere that I think there are 9 really at the moment: Bell, Foster, McCulloch, Wallace, Law, Black, McLeod, MIller & maybe Boyd. If Mohsni plays on Friday that would make 10; meaning only one wide MF place available for all comers.

  15. I am not sure how many times I have to tell you that I am not pro-board, I have stated clearly several that they have yet to gain my confidence. In any event as has been highlighted numerous times, being against King's actions does not make one pro-Board nor would it be vice versa. And there is no requirement on here to be balanced, we are not journalists writing a story for the beeb

It will happen again, he's just getting his excuses in early.
  18. BILEL MOHSNI admits it could be difficult for him to get back into the Rangers team after he served a suspension for his recent red card in the friendly at Derby County. The Tunisian defender was banned for two games following his headbutt on Rams player Chris Martin in the 2-0 loss at the iPro Stadium. Mohsni has apologised for his actions against Steve McClaren’s men and concedes he was stupid to react to a heavy challenge from the striker the way he did. Now he’s free to play again and could come into the reckoning for Friday’s trip to play Falkirk in the SPFL Championship. Lee McCulloch, Marius Zaliukas and Darren McGregor have all featured in central defence during Mohsni’s absence. And although there were no clean sheets against Hibernian or Hearts, the former Southend player knows he could still have slipped further down the pecking order. He said: “I was very, very upset with myself at Derby and I acted stupidly. When we gave the second goal away it was my fault and I didn’t defend well after. “It wasn’t about their player who tackled me. It was more about myself and I reacted badly.   19. I've had plenty of the he said or did this about this and that in the past and it's not pleasant I can assure you. I respectfully suggest that you get back to debating the issues and forget the accusations and he said, she said nonsense which is pretty unedifying for the Forum. It's boring to read anyway. If someone is giving opinions that don't reflect reality they'll soon become obvious and it won't be necessary to count the number of games they watched live, on RTV, dodgy streams, the internet, a bar in Benidorm or wherever. JMHO.
  20. I didn't mention "boycott". I said he was encouraging people not to buy the product; that doesn't mean ALL people as inn boycott and the "product" I was referring to were ST's. BTW I think then 44,000 was a bit more like my estimate than yours, mate, was it not? You can get the price of the Hearts game off your ST if you repent now
  21. And quite right too. If you were running a business would you enter into meaningful discussions with someone who was actively encouraging people not to buy your product? Well, I know YOU might, GS, but I'd suggest that most people would not.
